Conflicto de competencia suscitado entre el Juzgado Promiscuo de Familia de Málaga y el Juzgado Promiscuo Municipal de Cerrito (Santander), en torno al trámite de la acción de tutela de la referencia.
La Corte recuerda que por aplicación de las normas de reparto establecidas en el Decreto 1382 de 2000 no se autoriza al juez de tutela a declararse incompetente, en la medida en que la mencionada norma sólo prevé reglas administrativas para el reparto.
Se resuelve la controversia remitiendo el expediente al Juzgado del municipio de Cerrito, para que asuma de manera inmediata y sin dilaciones el conocimiento de la solicitud de amparo presentada.

- PRIMERO. DEJAR SIN EFECTOS el auto del 13 de agosto de 2015, por medio del cual el Juzgado Promiscuo Municipal de Cerrito Santander se declaró incompetente para conocer de la acción de tutela presentada por Wilmar Sánchez Tami contra Comparta EPS-S y la Secretaría de Salud de Santander.
- SEGUNDO. REMITIR el expediente al Juzgado Promiscuo Municipal de Cerrito Santander, para que asuma de manera inmediata y sin dilaciones el conocimiento de la acción de tutela de la referencia.
- TERCERO. Por Secretaría General, COMUNICAR al Juzgado Promiscuo de Familia del Circuito de Málaga, la decisión adoptada en esta providencia.
